The petitioners seek bail in connection with Farbeshganj P.S. Case No. 422 of 2024 instituted for the offence under Sections 341, 323, 324, 307, 302, 147, 148, 149, 354(B), 504, 342 & 506 of the Indian Penal Code (for short 'IPC'). Earlier anticipatory bail of the petitioners was rejected by a Coordinate Bench of this Court vide order dated 08.05.2025, passed in Cr. Misc. No. 88458 of 2024.

As per the prosecution story, the informant alleged that the one Brajesh Kumar came to the informant's house requesting the informant's husband (since deceased) to attend a

She later sent her daughter to call her husband but the daughter came and informed that he is being abused/assaulted. When she went to the place, she saw her husband was tied in a rope and was continuously beaten by all the accused persons. As she tried to save her husband, Sandhaya Devi and Parwati Devi (petitioners) caught hold of her.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 14.05.2025. Petitioners bear no criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioners' counsel that petitioners have been falsely implicated in the present case. From perusal of the FIR, it would manifest that the only allegation against the petitioners is of holding the wife of the deceased who was trying to save her husband from the assault. Apart from this, there is no specific allegation of assault against the petitioners. Charge Sheet is submitted in this case. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioners, there being no

Patna High Court CR. MISC. No.73023 of 2025(2) dt.14-10-2025 3/3 specific allegation of assault against the petitioners and charge sheet being submitted, this Court is inclined to grant bail to the petitioners.

Let the petitioners be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteeen Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Farbeshganj P.S. Case No. 422 of 2024.
