The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 120(B) of the Indian Penal Code.

As per prosecution case, the informant alleged that his father who was posted as Kakshpal at Hajipur Jail, was going to attend his duty and on the way, some unknown miscreants came and fired on his head as a result of which he died. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on the basis of suspicion. No.69862 of 2022(3) dt.15-03-2023 2/2 light on the basis of confessional statement of the co-accused Rudal Rai @ Krishna Mohan Kumar who is already getting the privilege of bail granted by a co-ordinate Bench of the Court vide order dated 20.07.2021 passed in Cr. Misc. No. 9555 of 2021 which is annexed as Annexure-2. The entire prosecution story hings around merely on suspicion. It is further submitted that the petitioner is languishing in judicial custody since 26.08.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Hajipur Sadar P.S. Case No. 619 of 2017 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur.
