The petitioner apprehends his arrest in connection with Mahishi P.S. Case No.150 of 2010 registered under Sections 420, 409 and 406/34 of the Indian Penal Code. The accusation is that petitioner being the Panchayat Secretary of Mahishi Panchayat received Rs.1,90,01,454/- for doing the certain work but the said work was not completed, as such, the petitioner defalcated the aforesaid amount. Learned counsel for the petitioner submits that after furnishing the vouchers of the bills, the petitioner deposited Rs.17,68,450/- and he also deposited Rs.82550/- in the SBI Mahishi and, thereafter, the Block Development Officer,
Patna High Court CR. MISC. No.66570 of 2019(2) dt.07-11-2019 2/2 Mahishi, issued "No Dues Certificate" on 17.05.2019, which would appear from Annexure-3 to this application. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate at District-Saharsa, in connection with Mahishi P.S. Case No.150 of 2010, subject to the conditions laid down under Section 438(2) Cr.P.C.
