The petitioner seeks regular bail in connection with Barari P.S.Case nO.218 of 2018 registered for offences punishable under Sections 302, 201,1 20(B)/34 of the Indian Penal Code. Allegation as per FIR is that one dead body was found lying in the Barandi river and he went there and found the dead body of his son there and suspected all the accused persons named in the FIR and in conspiracy they have killed his son. Submission of the learned counsel for the petitioner is that the petitioner is not named in the FIR and only on the suspicion, he has been made accused in this case and the materials collected during the course of investigation clearly shows that there is gun shot injury caused by Binna Choudhary.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Katihar in connection with Barari P.S.Case No.218 of 2018. With the aforesaid observation, this application is allowed.
