The petitioners are apprehending their arrest in a case initially registered under Sections 420, 465, 467, 468, 471, 120B, 323, 341, 447, 34 of the Indian Penal Code but cognizance has been taken under Sections 323, 420, 467, 468 of the Indian Penal Code only. The prosecution case in short is that the accused persons with common intention and under criminal conspiracy executed a sale deed, captured his land.

It has been submitted on behalf of the petitioners that the

Patna High Court CR. MISC. No.68730 of 2019(2) dt.16-11-2019 2/2 petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. It is a matter relating to the purchase of land which is civil in nature. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sree Rajeev Kumar Bharati, learned Additional Chief Judicial Magistrate-IV, Begusarai in connection with Complaint Case No. 1860 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
