JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 394, 302 of the Indian Penal Code and u/s 27 of Arms Act. .

FIR was registered against unknown for the murder of son of the informant.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation and except that there is no other material against the petitioner to suggest his complicity in the aforesaid crime. Petitioner claims clean antecedent.

Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.68738 of 2022(3) dt.01-05-2023 2/2 prayer for anticipatory bail and submits that during the course of investigation it has come that this petitioner opened fired upon the son of informant causing his death.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
