Heard learned counsel for the petitioners, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 76, 303(2) and 74 of the Bharatiya Nyaya Sanhita and Sections 7, 8 of POCSO Act.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on 31-10-2024 at 10 AM, Md Naushad and Saddam

Patna High Court CR. MISC. No.72462 of 2025(2) dt.12-11-2025 2/3 came and asked why she along with her mother did not come for doing work, on which the informant replied that her mother has gone for collecting cow dung, further Md. Saddam finding her along in the house started acting inappropriately with her, on protest Md Naushad started assaulting her, but she managed to flee, but was caught by Md Chand, Md. Kaiser and Md. Irfan, who assaulted and took her near their house where her mother on coming to know also came and thereafter informant managed to free herself with the help of her mother, further they assaulted her mother; and Saddam snatched Rs. 20,000/ which her mother had kept for depositing with the group. 4.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is also submitted that parties have compromised, as would manifest from Annexure-2 to the anticipatory bail application.

Learned counsel appearing on behalf of the informant does not dispute the said submission of the learned counsel appearing on behalf of the petitioners. 6.

Considering the submissions made by the learned counsel for the parties, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a

No.72462 of 2025(2) dt.12-11-2025 3/3 period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Goraul (Kathara) P.S. Case No. 438 of 2024 subject to the conditions as laid down under Section 482 (2) of the BNSS.
