Mr. Surya Narayan Sah, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 01-11-2025 Heard learned counsel for the petitioners, learned APP for the State as well as learned counsel appearing on behalf of the informant.

2. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 109(1), 303(2), 74, 352 and 351(2) of B.N.S., 2023.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no.1 is a woman and the informant alleges that Shilpi (petitioner no.1) assaulted her by rod causing injury on head while Archana and Praveen assaulted her by lathi below her waste and Shilpi

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegations, as alleged in the FIR, it would manifest that petitioner no.2 is alleged to have assaulted the informant by lathi along with Archana below her waste. It is next submitted that since petitioner no.2 is husband of petitioner no.1, as such, he came to be implicated. It is also submitted that no doubt petitioner no.1 is alleged to have assaulted the informant by rod causing injury on head but then on account of dispute relating to land an altercation had taken place in which both sides assaulted each other. It is further submitted that petitioner no.1 is a woman and has children to look after and this is her first offence. It is also submitted that such offence will never be repeated.

The learned APP and the learned counsel appearing on behalf of the informant oppose the anticipatory bail application and submit that petitioner no.1 is alleged to have assaulted the informant by rod causing grievous injury on head as recorded in the impugned order, as such, it is not a fit case for

No.70578 of 2025(2) dt.01-11-2025 3/3 granting anticipatory bail to the petitioner no.1 on which the learned counsel for the petitioners reiterates the submission and submits that petitioner no.1 is a woman and it is her first offence and such offence will never be repeated in future.

6. Considering the submissions made by the learned counsel for the petitioners, let petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Medani Chowki P.S. Case No.42 of 2025, subject to the conditions as laid down under Section 482 (2) of the B.N.S.S. (Satyavrat Verma, J) Sanjay/- U T
