JUSTICE ARUN KUMAR ORAL ORDER 01-07-2017 Heard learned counsel for the petitioners and the learned APP appearing on behalf of the State. Petitioners apprehend their arrest in connection with Excise Case No.394 of 2017, arising out of Ariyari (Kasar) P.S. Case No.84 of 2017 registered under Sections 147, 148, 149, 341, 323, 324, 325, 332, 333, 337, 338, 307, 353, 504 and 506 of the Indian Penal Code as well as Section 30(a) (c) (d) of the Bihar Prohibition and Excise Act, 2016.

Allegation in brief is that when police reached in the village after getting news that some of the accused persons are engaged in selling illegal toddy and started making enquiry then these petitioners started assaulting over the police party causing

Patna High Court Cr.Misc. No.29025 of 2017 (2) dt.01-07-2017 2 / 2 injury.

Learned counsel for the petitioners submits that against these petitioners, who are females, there is general and omnibus allegation of assault and the specific allegation is against Dashrath Choudhary, his son Sanoj Choudhary and one Basanti Devi. There is no allegation against these petitioners that they were indulged in any illegal trading of toddy and they have no criminal antecedents. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Additional District & Sessions Judge, Sheikhpura in connection with Excise Case No.394 of 2017, arising out of Ariyari (Kasar) P.S. Case No.84 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Arun Kumar, J.) S.Kumar/- U T
