Petitioner is apprehending his arrest in connection with Basantpur P.S.Case No.190 of 2019, registered for offences punishable under Sections 302/34 of the Indian Penal Code. As per the FIR, husband of the deceased has taken poison and due to that he died and there is allegation that the petitioner who happens to be wife and her family members have administered poison to him as he was at that time in his Sasural.

Submission of the learned counsel for the petitioner is that there is no other allegation against the petitioner of having any illicit relation with anyone and only because she is wife wife, she has been implicated in this case and it has also

Patna High Court CR. MISC. No.68603 of 2019(3) dt.14-11-2019 2/2 come that Sasural people have also taken him to the Hospital and informed about the same to the father and mother of the deceased , as such except suspicion there is nothing against him.

Heard learned A.P.P. and the learned counsel for the informant, who has opposed the prayer for bail stating that the deceased died at his Sasural and the petitioner was present there..

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Basantpur P.S.Case No.190 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
