JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-12-2018 The petitioner seeks regular bail in connection with Ram Krishna Nagar P.S. Case No. 377/2018, registered for offences punishable under Sections 37 (B) (C) of Bihar Excise Act and Sections 341, 323, 354(B), 506, 509 and 34 of the Indian Penal Code.

Allegation against the petitioner and other accused persons is that they abused the informant and also pulled her dupatta. Thereafter, they were apprehended by the villagers and it was found that the petitioner and others were in drunken condition.

It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and he has been in judicial custody since 17.09.2018 and co-accused persons

Patna High Court Cr.Misc. No.73373 of 2018(2) dt.13-12-2018 2/2 having similar allegation has already been enlarged on bail by this Court vide order dated 06.12.2018 passed in Cr. Misc. No. 70179 of 2018.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Ram Krishna Nagar P.S. Case No. 377/2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
