2. The petitioner has preferred this application for grant of regular bail in connection with Yadopur P.S. Case No. 52 of 2025, Sessions Trial No. 432/2025 dated 26.03.2025 registered for the offences punishable u/ss 126(2), 115, 118(2), 103(1), 117, 109, 352, 351(2) read with section 3(5) of the BNS.
3. As per the prosecution case, on the issue of land dispute, the petitioner and the co-accused persons armed with various weapons came to the door of the informant and started assaulting him and his family members. It is further alleged that Bidya Yadav assaulted the informant's father with knife causing injury to him and, in the meantime, Shailendra Kumar Yadav
Patna High Court CR. MISC. No.70209 of 2025(2) dt.28-11-2025 2/3 also committed murder of Lalwati Devi by stabbing. When the informant's elderly mother came to rescue, the co-accused, Guddu Yadav inflicted knife blow on her causing injury.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is no specific allegation against the petitioner. The specific allegation of stabbing the deceased is against the co-accused Shailendra Kumar Yadav. The allegation against the co-accused, Guddu Yadav is of inflicting knife blow on the elderly mother of the informant and her injury is stated to be simple in nature. The co-accused persons have already been granted bail by this court vide order dated 21.08.2025 passed in Cr. Misc. No. 50521/2025. The petitioner has no concern with the alleged offence. The petitioner has three criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 01.07.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of
Patna High Court CR. MISC. No.70209 of 2025(2) dt.28-11-2025 3/3 the like amount each to the satisfaction of learned Court concerned, Gopalganj in connection with Yadopur P.S. Case No. 52 of 2025, Session Trial No. 432/2025 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
