The petitioner apprehends his arrest in a case registered for the offences punishable under Section 341, 324, 307, 379/34 of the Indian Penal Code.

The prosecution story, in short, is that on 01.12.2021 around 11.00 hrs in day time, the informant was going to Bank of Barauda, Revilganj with one Shubham Kumar by his bullet motorcycle and when he reached near Revilganj Thakurbari, all the accused persons including the petitioner-accused had surrounded him and started abusing. Petitioner ordered Niraj and Santosh to stab knife at which accused Niraj Singh stabbed knife on his arm and stomach due to which the informant fell down. When Shubham came to rescue, the accused Golu Singh caught his hand and accused Ashish Singh stabbed knife in his stomach and back. Petitioner is said to have taken Rs. 10,000/- from the pocket of the informant.

Patna High Court CR. MISC. No.69710 of 2022(2) dt.28-02-2023 2/2 It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No such occurrence as alleged ever took place. He has been falsely implicated in this case due to election enmity. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. There is specific allegation of stabbing the knife against the co-accused Niraj Singh, Santosh and Ashish Singh. Petitioner has no criminal antecedent as mentioned in para-3 of this application. Learned APP for the State opposed the prayer for bail.

Having regard to the facts and circumstances of the case, as there is no specific overt act against the petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Revilganj P.S. Case No.

(2) of the Cr.P.C.
