This is an application for bail in connection with Baniyapur P.S.Case No. 02 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner is of stabbing the deceased twice and causing his death.

It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case because he is brother of the girl with whom the deceased had love affairs and petitioner is in custody since 3.1.2017.

Heard learned APP also.

Having heard both sides and in view of direct allegation against the petitioner, I am not inclined to grant bail to

Patna High Court Cr.Misc. No.32044 of 2017 (3) dt.02-08-2017 2/2 the petitioner.

However, learned trial court is directed to expedite the trial and try to conclude it within one year. With the above observation, this application is dismissed.
