The petitioner apprehends his arrest in connection with Bibhutipur P.S. Case No. 349 of 2018 registered under Sections 385, 387, 420, 467, 468 and 471 of the Indian Penal Code. The accusation is that seven persons named in the FIR including the petitioner under conspiracy with deed-writer and some unknown got executed the sale deed in respect of Plot No. 6787, on which house and office of informant, Promod Kumar is situated, in favour of Sukhdeo Singh by putting Lalita Devi in place of Laxmi Devi and in whose name Plot No. 6788 is recorded, while Upendra Singh has no concerned with Plot No. 6787.

Learned counsel for the petitioner submits that informant has no concerned about the Plot No. 6787 as detailed in

Patna High Court CR. MISC. No.64502 of 2019(3) dt.04-12-2019 2/2 the FIR but with ulterior motive the present case has been lodged with false allegation. Further submission is that in the counter affidavit filed by the informant, Annexure B-I, is the information received by the informant from Circle Officer, which indicates that Plot No. 4808 area 4.5 decimal is in the name of informant, Promod Kumar, in Register-II not the Plot No. 6787 as detailed in the FIR. Petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned A.C.J.M-I, Rosera, Samastipur, in connection with Bibhutipur P.S. Case No. 349 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
