The petitioners apprehend their arrest in connection with Morkahi P. S. Case No. 18 of 2017 instituted under Sections 147, 149, 307,323, 341, 354, 379, 447, 504 and 506 of the Indian Penal Code.

The allegation, in brief, is that accused persons came to the field of the informant and demanded extortion and on protest, they assaulted the informant's son and others with lathi. Learned counsel for the petitioners submits that there is land dispute between both sides and case and counter case have been lodged by both sides and earlier case has been lodged a day before by the petitioner's sides and the present case is lodged after

Patna High Court Cr.Misc. No.30135 of 2017 (2) dt.06-07-2017 2/2 two days and the injury found on the persons of the two injured is simple in nature and the petitioners have clean antecedent. Having considered the aforesaid facts and circumstances, let the petitioners, namely, Pramod Prasad Singh, Umesh Prasad Singh, Ashok Prasad Singh and Nitu Kumar, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M, Khagaria in connection with Morkahi P.S.Case No. 18 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
