The petitioner seeks bail in Kotwali (Barari) P.S. Case No. 609 of 2016 registered under Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, on the order of Bagru Yadav and the petitioner, Karu Yadav opened fire which hit on the waist of the informant.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. He has been falsely implicated in this case. No overt act is attributed against the petitioner. He happens to be mere order

Patna High Court Cr.Misc. No.29392 of 2017 (2) dt.01-07-2017 2/2 giver. Co-accused Bagru Yadav @ Dharmendra Yadav has been enlarged on bail by this court vide order dated 13.04.2017 passed in Cr. Misc. Nos. 14127 of 2017. The petitioner has been languishing in custody since 10.05.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P.S. Case No. 609 of 2016.
