The petitioner apprehends her arrest in connection with Murliganj P.S. Case No. 195 of 2019, registered under Section 143, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code and later on, Section 302 of the Indian Penal Code has been added. The accusation is that on hearing Hullah about causing assault to Sunita Devi, sister of the informant, Bibha Devi, by her husband and in laws, informant along with her husband, Bablu Mandal, reached there then Gulab Chandara, Manju Devi (petitioner), Mohan Kumar and Rupesh Kumar started to abuse to her husband. At that time, Mohan Mandal caused injury to her husband through bamboo stick causing injury at his head. Thereafter, all started to assault the informant and her Gotni Rekha Devi through

Patna High Court CR. MISC. No.64446 of 2019(2) dt.05-11-2019 2/2 lathi and Danda. In the meantime, Gulabchand Mandal, snatched gold chain from her neck. Thereafter, her husband was rushed to PHC, Murliganj from where, he was referred to Madhepura Hospital, where her husband died in course of treatment. Learned counsel for the petitioner submits that, in fact, petitioner is the Gotani of Sunita Devi, sister of the informant and she has also been implicated in the present case without any specific overt act. Further submission is that petitioner, who is lady, has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Madhepura, in connection with Murliganj P.S. Case No. 195 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
