This is a petition for grant of regular bail for offence under Sections 8 and 20(b)(ii)(A) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Four hundred and seventy five grams ganja was recovered from the possession of the petitioner. Though the petitioner has disclosed his criminal antecedent in paragraph 3 of the petition. However, submission is that the petitioner is not named in any of the aforesaid cases nor any of the cases were registered under the Narcotic Drugs and Psychotropic Substances Act, 1985.

The submission is that the recovered quantity comes within the purview of small quantity.

Considering the nature of allegation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Special Case No. 55 of 2017 arising out of Bihta P.S. Case No. 252 of 2017 to the satisfaction of the Sessions Judge-cum-Special Judge, Patna, or successor Court.
