====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 13-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends arrest in a case registered under Sections 30(a) and 47 of Bihar Prohibition and Excise Act.
3. As per the prosecution case, 190.86 litres of illicit liquor was recovered from Magic vehicle bearing Reg. No. BR24-GA-7623. The driver of the said vehicle, namely, Shrawan Bind apprehended on the spot who disclosed that the said liquor belongs to one Manish of Jamuhar village having phone no. 6205074724 and one Raja of Amra Talab having phone no. 9273505582.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Further
Patna High Court CR. MISC. No.69843 of 2025(2) dt.13-10-2025 2/2 submission is that petitioner has no concern either with the seized illicit liquor or seized vehicle. The phone number provided by the apprehended co-accused does not belong to the petitioner. Petitioner was not present on the spot and nothing has been recovered from the conscious possession of the petitioner. Petitioner has no criminal antecedent and he undertakes to cooperate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned in connection with Mohania P.S. Case No. 655 of 2022, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023.
