This is a case registered under Section 30(a) of the Bihar Prohibited Amendment Excise Act, 2016.
It is submitted by counsel for the petitioner that there is no recovery from the petitioner. He submits that as per allegation only 10 liters of country made liquor and some raw material allegedly used for making wine was also recovered. The recovery was not from the petitioner. He has no criminal antecedent and he is in custody since 31.08.2018. He submits that he has falsely been implicated in this case. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs
Patna High Court Cr.Misc. No.75958 of 2018(2) dt.17-12-2018 2/2 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Bettiah, West Champaran in Sahodra P.S. Case No. 35 of 2017 subject to the conditions :
(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.
(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
