JUSTICE SANJAY PRIYA ORAL ORDER 24-07-2017 Heard learned counsel for the petitioners and the State. The petitioners apprehend arrest in Hathauri P.S. Case No. 47 of 2017 instituted for the offence under Sections-272/273 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016. It is alleged in the written report that foreign liquor was recovered from a truck and bolero car near the orchard, where four persons were standing. Seeing the raiding party proceeding towards them, the four persons fled shouting the names of each others. The chowkidar disclosed the name of accused persons including the petitioner. Seizure list is enclosed with the written report at page 14, from perusal of which, it appears that 1200 litres foreign liquor has been recovered from a truck and bolero car.

In such circumstances, this court does not find it a fit case for grant of anticipatory bail. Accordingly, prayer for anticipatory bail

Patna High Court Cr.Misc. No.29406 of 2017 (3) dt.24-07-2017 stands rejected.

The petitioner is directed to surrender in the court below and seek regular bail which will be considered and disposed of on its own merit without being prejudiced by this order. (Sanjay Priya, J) A.K.V./- U T
