2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 342, 323 , 307, 379, 427, 506, 524, 324 and 34 of the Indian Penal Code .

3. As per the prosecution case , on the alleged date and time of occurrence this petitioner along with other coaccused persons assaulted informant with butt of pistol. It is further alleged that they also took out Rs. 50 thousand and mobile from the pocket of informant.

4. Learned counsel for the petitioner submits that as a matter of fact, informant is co-villager of petitioner and informant has taken loan of Rs. 1 lakh from his full brother Raju

Patna High Court CR. MISC. No.75813 of 2023(4) dt.27-08-2024 2/2 Sahani (co-accused) which has not been returned till date due to which a scuffle took place in between both the parties. Case and counter case . Injury sustained by injured is found to be simple in nature . Rest of the allegations are ornamental in nature .

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the nature of injury , case and counter case and other circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM , East Champaran Motihari in connection with Pipra P.S. case No. 78 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
