Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Tikapatti P.S. Case No.88 of 2022 registered under Section 420 of the Indian Penal Code and Section 7 of Fertilizer Control Order and Sections 7(i)(a)(ii) of the E.C.Act. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is an agriculturist and has purchased the fertilizer for its his own purpose and not for sale. No any license is required

Patna High Court CR. MISC. No.69667 of 2022(2) dt.01-05-2023 2/2 for storage of fertilizer. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of C.J.M., Purnea in connection with Tikapatti P.S. Case No.88 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arvind Srivastava, J) Harish/- U T
