Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 11.10.2017 passed in Cr.Misc.No. 46800 of 2017 and the allegation against the petitioner, who happens to be husband of deceased, is of causing her death and it further appears that some injuries were found on the person of deceased and dead body was found in the field of the petitioner. Learned counsel for the petitioner submits that dead body was not recovered from his house, rather from the field and petitioner has falsely been implicated only on suspicion and he is in custody for more than two years. Further submission is that not a single witness has been examined.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner.
Patna High Court Cr.Misc. No.74220 of 2018(2) dt.20-12-2018 2/2 However, since the petitioner is in custody for the last two years, learned trial court is directed to expedite the trial by conducting it on regular basis and at the same time Superintendent of Police, Siwan is directed to ensure the presence of the witnesses in court on the date fixed so that the trial may be concluded as early as possible.
With the above observation, this application is dismissed.
