JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 This is an application for grant of anticipatory bail in connection with Ara Muffassil P. S. Case No. 181 of 2019, disclosing offences under Sections 147, 148, 323, 504, 307 and 427 of IPC.
As per F.I.R. petitioner no.1 is said to have assaulted the wife of the informant by lathi on the back thigh whereas petitioner no.2 has assaulted by knife to the daughter of the informant on the neck. Petitioners no.3 and 4 are also named in the F.I.R and one accused Raj Kumar is said to have assaulted the informant.
Patna High Court CR. MISC. No.64848 of 2019(2) dt.17-10-2019 2/3 Submission of the learned counsel for the petitioners is that there is case and counter case between the parties. Some of the petitioners have also received injuries, which will appear from Annexure 4. Except the injury report of the informant, there is no injury report available on the record. Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that apart from the allegation, there are criminal antecedent of the petitioners also, as they are accused in several other cases, which has been defended by the learned counsel for the petitioners saying that all those cases have been filed by informant and his family members. Having heard both sides, in view of the facts, as stated above, so far as, petitioner no.2 is concerned, I am not inclined to grant privilege of anticipatory bail to him. However, he may surrender before the learned court below and make prayer for regular bail.
So far as, petitioners no.1,3 & 4 are concerned, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Ara
