Heard the learned counsel for the petitioner and the learned APP for the State.

The present petition is by way of second attempt at the behest of the petitioner for grant of regular bail in connection with Industrial Area PS case no. 206 of 2019, registered under Section 392 of the Indian Penal Code, inasmuch as earlier, the bail petition of the petitioner was dismissed as withdrawn vide order dated 28.06.2023, passed in Cr. Misc. no. 36074 of 2023, however with liberty to renew his prayer for bail afresh after three months.

The allegation, as per the FIR, is that the informant was going to Hazipur by his Scooty bearing registration no. AP 31ER 6709. Four persons on two vehicles armed with pistol

Patna High Court CR. MISC. No.74996 of 2023(2) dt.24-11-2023 2/3 came and snatched his Scooty and a bag containing Aadhar Card, Pan card, ATM etc.

Learned counsel for the petitioner has submitted that the FIR is against four unknown persons and petitioner is not named in the FIR. He further submits that petitioner was arrested in another case bearing Industrial Area PS case no. 211 of 2019, in which the confessional statement of the petitioner was recorded and on the basis of that, he has been made accused in the present case. He also submits that no incriminating article or looted article has been recovered from the possession of the petitioner and he is languishing in custody since 10.08.2022. Lastly, it is submitted that no T.I.P. has been conducted. 5.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into consideration the fact that this is the second attempt of the petitioner for grant of bail, petitioner is in custody since 10.08.2022 and his name has transpired on the basis of his confessional statement, I deem it fit and appropriate to admit the petitioner to the privilege of bail. 6.

Accordingly, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty Five thousand) with two sureties

No.74996 of 2023(2) dt.24-11-2023 3/3 of the like amount each to the satisfaction of learned court of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Industrial Area PS case no. 206 of 2019. It is further directed that the petitioner shall appear before the learned trial court on each and every date so fixed by the trial and in default of two consecutive appearances, the present privilege of regular bail shall liable to be cancelled.
