This application is for modification of order dated 13.09.2019 passed in Cr.Misc.No.57179 of 2019 Allegation against the petitioner is that liquor was recovered from his shop and petitioner had got identical criminal antecedent. Petitioner is in custody since 19.08.2019. By order dated 13.09.2019 passed in Cr.Misc.No.57179 of 2019, the petitioner was allowed bail by this Court with condition that he shall be released, if the trial is not concluded within six months from the date of framing of the charges. Submission is that charges have been framed on 30.09.2019. However, no prosecution witness has turned up
Patna High Court CR. MISC. No.64225 of 2019(2) dt.08-01-2020 2/2 uptil now and there is no chance of early conclusion of the trial. Considering the aforesaid facts, let the above named petitioner be released on regular bail soon after furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge Excise, Siwan in connection with Jeeradai P.S.Case No.23 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
