1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 352, 351(2), 351(3) and 3(5) of the BNS, 2023.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that while he was coming back home, he was intercepted by the accused persons and on orders of Rajshwar Rai, accused Dayanand and Sanjeet assaulted him with gandasa and rod causing injury on head, thereafter Bablu Rai assaulted by dab causing injury on head while four named female accused assaulted him by fist, but was rescued by the villagers and was

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that no reason for the occurrence is alleged. It is next submitted that from side of the petitioner, Awatar Nagar P.S. Case No. 138 of 2025 has been instituted against the informant and his side. It is further submitted that father of the petitioner had instituted Complaint Case No. 1992 of 2020 against the informant and his family members as they were threatening the petitioner's side to sell their house, as such, the informant side was pressuring his father to withdraw the complaint case. It is further submitted that the injury suffered by the injured is simple in nature, which amply demonstrates that petitioner never had any intention of committing a serious occurrence. It is also submitted that petitioner is not a criminal.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court

No.71715 of 2025(2) dt.15-10-2025 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Awatar Nagar P.S. Case No. 139 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.

7. Accordingly, the instant anticipatory bail application stands allowed.
