In this case, the bail application was allowed on 13.10.2022 vide Cr. Misc. No. 40452 of 2022.
In the said petition, on instruction, the learned counsel for the petitioner submitted that the petitioner's side was ready to pay a sum of Rs. 25,000/- towards the treatment cost of the informant as also Rs. 5000/- to the Patna High Court Legal Services Committee.
Now the present petition has been filed stating that although an undertaking was given for payment, the petitioner is not in a position to pay the aforesaid amount and as such had failed to take the benefit of the order and has remained in custody.
Patna High Court CR. MISC. No.1722 of 2023(2) dt.11-01-2023 2/2 Taking into account the averment made in the petition, the order dated 13.10.2022 stands modified to the extent as follows:- The petitioner is not required to pay Rs. 25,000/- towards treatment cost or Rs. 5000/- to the Patna High Court Legal Services Committee.
"Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each in connection with Katoriya P.S. Case No. 218 of 2021 to the satisfaction of learned Chief Judicial Magistrate, Banka".
With the aforesaid modification, the Cr. Misc. No. 1722 of 2023 stands allowed.
