JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 01-08-2017 Inter alia contending that in survey plot nos. 3912, 3919, 3956 its new road no. 6816 situated in Ward No. 10 and 11, Anchal Darbhanga Gramin, District-Darbhanga, encroachment has been done and since in spite of repeated complaints and representation made to the respondent nos. 3, 4 and 5, nothing was done, this writ application has been filed in public interest. Keeping in view the aforesaid grievance of the petitioner and without expressing any opinion on merit of the allegation, in the interest of justice, respondent no.5, the statutory authority under the Bihar Public Land Encroachment Act, is directed to take action in the matter.
Patna High Court CWJC No.9190 of 2017 (2) dt.01-08-2017 2/2 We, accordingly, direct that on the petitioner filing a certified copy of this order along with relevant documents, the respondent no.5 shall take action under the Bihar Public Land Encroachment Act and after hearing all concerned, shall proceed to ensure that encroachment, if any, on the areas existing is removed within a period of six months.
