2. The petitioner seeks bail in a case registered for the offence punishable under Sections 408, 409 & 420/34 of the Indian Penal Code.

3. The petitioner in association of other co-accused is said to have embezzled the government money of Rs.65,38,085/-.

4. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case. It is further submitted that the petitioner is an elected member of Khairwa PACS and was appointed as a Secretary/Manager of the PACS. The petitioner is not responsible for paddy and

Patna High Court CR. MISC. No.74409 of 2024(5) dt.21-02-2025 2/2 supply of CMR to the State Food Corporation and the Chairman of the PACS is fully responsible for financial activities. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The specific allegation is against co-accused, Naushad Alam, who has already been granted anticipatory bail by this Court vide order dated 18.12.2024 passed in Cr. Misc. No.87083 of 2024. The petitioner has one criminal antecedent and has been languishing in custody since 04.09.2024

5. Learned APP for the State opposed the bail petition.

6. Considering the facts aforesaid and the fact that no any evidence has come on record during investigation against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Chhauradano P.S. Case No.209 of 2024.
