Petitioner is in custody in connection with Gardanibagh PS Case No. 424 of 2018 for the alleged offence under Sections 419, 420, 467, 468,471, 472 and 120B of the Indian Penal Code.

Allegation against the petitioner is that he has used another person for appearing at the Higher Secondary Examination. Learned counsel representing the petitioner submits that the petitioner is in custody since 23.09.2018. He further submits that the petitioner has no criminal antecedent and that similarly circumstanced co-accused persons have been granted bail by Coordinate Bench of this Court vide orders dated 14.12.2018 and 20.12.2018 in Cr. Misc. Nos. 74319 of

Patna High Court Cr.Misc. No.77373 of 2018(2) dt.11-01-2019 2/2 2018 and 76944 of 2018, respectively.

Considering the totality of the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate XIVth, Patna in connection with Gardanibagh PS Case No. 424 of 2018.
