1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 342, 323, 324, 307, 354, 379 and 506 of the Indian Penal Code as well as Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that petitioner has antecedent of one case and has been falsely implicated in the instant case by the informant. It is further submitted that Gulshan Kumar along with four others had approached this Court seeking anticipatory bail by filing Cr. Misc. No. 73407 of 2024 and the same came to be allowed by an order dated 20.12.2024. It is next submitted that while granting the privilege of anticipatory bail to Gulshan Kumar and others, this Court had considered the case on merit. It is also submitted that as far as this petitioner is concerned, he is alleged to have assaulted the informant by an iron rod causing

No.74417 of 2024(2) dt.24-01-2025 2/2 injury on head but then the blow was not repeated and the injury is opined to be simple in nature which amply demonstrates that petitioner never had any intention of committing a serious offence. It is submitted that from side of the petitioner Islampur P.S. Case No. 226 of 2024 has been instituted against the side of the informant and others and on account of dispute relating to land, the instant false case came to be instituted.

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Islampur P.S. Case No. 223 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Kundan/- U T
