====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 11-12-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in Sugauli P.S. Case No. 409 of 2018 instituted for the offence under Section(s) 414 Indian Penal Code.

It is alleged in the written report that one Motorcycle has been recovered from possession of the petitioner. On demand of paper of the Motorcycle, he could not produce the same.

Counsel for the petitioner submits that petitioner has been arrested merely on suspicion. The real person managed to run away and petitioner has been apprehended. Petitioner is in custody since 29.9.2018.

In the facts and circumstances of the case, prayer of

Patna High Court Cr.Misc. No.74048 of 2018(2) dt.11-12-2018 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, in connection with Sugauli P.S. Case No. 409 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
