The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 420, 406, 409, 467, 468 and 471 of the Indian Penal Code. The petitioner is wife of Md. Mokkaram one of the Directors of the company. The allegation of cheating is against the company. Co-accused Raj Gopal Pandey, who was staff of the company, has already been allowed anticipatory bail by a Coordinate Bench of this Court in Cr. Misc. No. 4031 of 2016 on 10.05.2016.
Submission of the learned counsel for the petitioner is that there is no material to substantiate involvement of the
Patna High Court Cr.Misc. No.33355 of 2017 (3) dt.19-08-2017 2/2 petitioner in the affairs of the company.
Considering the aforesaid facts, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur/successor Court in connection with Kotwali (Adampur) Police Station Case No. 45 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
