JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 The petitioner apprehends his arrest in connection with Karpi P.S.Case No. 07 of 2018 registered under Sections 365, 366A, 504/34 and 376 of the Indian penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant.

Submission of learned counsel for the petitioner is that later on land dispute has been settled between the parties and they have filed a compromise petition before the court below and there is also delay in lodging the FIR.

Heard learned APP also who has opposed the prayer of anticipatory bail stating that victim girl, in her statement recorded under Section 164 Cr.P.C., states about the commission of rape.

Having heard both sides and in view of allegation made

Patna High Court Cr.Misc. No.77731 of 2018(2) dt.02-01-2019 2/2 against the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner. Let petitioner surrender and make prayer for regular bail which shall be considered by the learned court below on its own merit.
