It is submitted by the learned counsel for the petitioners that the petitioners are innocent and have been falsely implicated in the present case. The recovery of a country made pistol and one live cartridge was made from the joint house and the father and brother of the petitioners were arrested on the date of seizure itself. It is further stated that the petitioners were not present in the house and they were not aware under what circumstances the seizure of arm was made from their house. He has further contended that the petitioners have no criminal antecedent but on the same day the police implicated them in another case.

Patna High Court Cr.Misc. No.31458 of 2017 (4) dt.23-08-2017 2/2 Learned counsel for the State has submitted that when the father of the petitioners was questioned by the police, he had disclosed that the recovery was made from the room where three of his sons used to live.

Considering the facts and circumstances of the case, the provisional pre-arrest bail granted to the petitioners by order dated 13.07.2017 is hereby confirmed.
