Petitioner seeks bail in Excise Case No. 162 of 2018 instituted for the offence under Section(s) 30(A) of the Bihar Prohibition and Excise (Amendment) Act, 2018. In the written report it is alleged that Police stopped two vehicles in checking. Two persons were found sitting on Tata Safari vehicle namely, Amarjeet Kumar and Kailash Prasad Singh. The petitioner was found sitting in another Tata Tiago car. It is further alleged that police party recovered foreign liquor from Tata Safari car. There is no recovery of any foreign liquor from possession of petitioner or from the car in which he was found sitting.
Patna High Court Cr.Misc. No.73995 of 2018(2) dt.11-12-2018 2/2 Petitioner is in custody since 1.11.2018 having clean antecedent.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional District and Sessions Judge-cum-Special Judge, Excise, Bhagalpur, in connection with Excise Case No. 162 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
