The petitioner seeks bail in a case registered under Sections 341, 323, 307/34 of the Indian Penal Code and 3⁄4 of Explosive Substances Act.

The prosecution case in short is that the co-accused namely Md. Jibrail had kept a bomb, which suddenly exploded. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 23-04-2019. Charge sheet has already been submitted. No overt act is alleged against the petitioner. The main allegation is against co-accused, namely Md. Jibrail.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka (Barahat) P.S. Case No. 248 of 2019.
