The petitioner seeks bail in connection with Sherghati P.S. Case No. 253 of 2019, registered for offence punishable under Sections 414 and 120(b) of the Indian Penal Code, Sections 3 and 4 of Explosive Substance Act and Sections 10, 13, 18, 20, 38 and 39 of the Unlawful Activities (Prevention) Act.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that from perusal of seizure list, it appears that only one white colour Samsung mobile phone has been recovered from the possession of the petitioner. He further submits that the petitioner is not an
Patna High Court CR. MISC. No.64511 of 2019(2) dt.08-11-2019 2/2 owner, he is only driver of the alleged vehicle. The petitioner has no criminal antecedent and he is in custody since 06.06.2019.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati (Gaya) in connection with Sherghati P.S. Case No. 253 of 2019.
