Petitioner apprehends arrest in connection with Bhabua P.S. Case No. m805 of 2023 registered for the offence under sections 30(a)(c)(d)/41 of the Excise Act. Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged in the first information report and he has been falsely implicated in this case. The alleged recovery has been made from the orchard of Kashi Bind. Petitioner has no concern either the said orchard or with the seized liquor.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named, in the event of arrest or surrender

Patna High Court CR. MISC. No.77176 of 2023(2) dt.29-11-2023 2/2 within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge IV, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 805 of 2023 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
