JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-07-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Salkhua P.S. Case no. 21 of 2012, registered for the offence under Sections 457, 380 of the Indian Penal Code.

The case of the prosecution is that petitioner is said to have committed theft in the house of the informant and was apprehended while trying to flee away.

The learned counsel for the petitioner submits that the petitioner has clean antecedent and no recovery has been made from his possession. It is the further case of the petitioner that similarly situated co-accused persons have been granted bail vide order dated 25.06.2012 passed in Cr. Misc. No. 23132 of 2012 and order dated 27.09.2012 passed in Cr. Misc. No. 36410 of 2012. The petitioner is in custody since 31.03.2017

Patna High Court Cr.Misc. No.33660 of 2017 (2) dt.20-07-2017 2/2 Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Saharsa in connection with Salkhua P.S. Case no. 21 of 2012 (G.R. No. 130 of 2012).
