2. The petitioner seeks bail in a case registered for the offence punishable under Sections 111, 287, 324(5), 61(2) of the B.N.S., sections 15(2)/15(4) of the P.M.P. Act, section 3/4 of the E.S. Act, section 3/4 of the P.D.P.P. Act and section 7 of the E.C. Act.
3. The allegation in the First Information Report is that some unknown miscreants tried to tap the gas pipeline of Indian Oil Corporation resulting in a fire incident.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.70475 of 2025(3) dt.17-11-2025 2/3 name of the petitioner and other co-accused persons transpired in this case during course of the investigation on the confessional statement of other co-accused and the petitioners self confession. The allegation was that they were making an attempt to commit a theft of oil through the said gas pipe line. It is further submitted that there is no recovery from the petitioner and it is only on the basis of suspicion that he was remanded in the present case. The petitioner is in custody since 30.05.2025 and the charge-sheet has been submitted. It has also been pointed out that the similarly situated co-accused namely, Manish Kumar @ Manish Ray has been granted regular bail by a coordinate bench of this Court vide order dated 24.09.2025 passed in Cr. Misc. No. 66921 of 2025.
5. Learned APP for the State and learned counsel appearing on behalf of the IOCL however vehemently opposed the grant of bail on the basis of allegations made in the First Information Report and also the materials disclosed during course of investigation.
6. Taking into account the facts and circumstances and also considering the fact that baring confession before the Police which has no evidentiary value, there is no other substantive material to connect the petitioner with alleged offence, coupled

No.70475 of 2025(3) dt.17-11-2025 3/3 with the fact that similarly situated co-accused namely, Manish Kumar has already been granted regular bail, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor Court in connection with Garkha P.S. Case No. 478 of 2024 subject to the following conditions:- (I). The petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
