Mr.Ataur Rahman ====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 10-01-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 15.09.2018 in connection with Sakra P.S. Case No.415 of 2018 registered under Sections 413/414/34 of the Indian Penal Code. Learned counsel for the petitioner submits that only because a stolen motorcycle was found lying on the doorsteps of the petitioner, the present allegation of theft of motorcycle has been levelled against the petitioner. It is further submitted that the said recovery was not from his conscious possession and he has no criminal antecedent. Learned counsel for the petitioner further submits that none of the seizure list witnesses are local people nor has the self confessional statement made by the petitioner before the police has any evidentiary value. It is thus

Having considered the entire facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Judge-XIII cum A.C.J.M. IV, Muzaffarpur in connection with Sakra P.S. Case No.415 of 2018.
