2. The petitioner seeks bail in connection with Triveniganj P.S. Case No. 210 of 2025, instituted for the offences punishable under Sections 126(2), 115(2), 352, , 351(2), 109(1), 303(2) & 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

3. The prosecution case, in short, is that the petitioner along with other co-accused persons started ploughing the field of the informant. It is further alleged that when father-in-law of the informant intervened in the matter, then the co-accused gave an order to kill informant's father-in-law and bury him in the

Patna High Court CR. MISC. No.70542 of 2025(3) dt.17-11-2025 2/3 land, thereafter petitioner allegedly fired on his head. They also misbehaved with the informant and tried to kill her husband but on seeing the villagers coming towards them, they fled away from the spot.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submits that the allegation levelled against the petitioner is of firing but injury report does not support the allegation as the injury is opined to be caused by hard and blunt substance. The petitioner is in custody since 29.04.2025 and has got no criminal antecedent. Other co-accused has been granted bail by this Court vide order dated 19-08-2025, passed in Cr. Misc. No. 54965 of 2025.

5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail

Patna High Court CR. MISC. No.70542 of 2025(3) dt.17-11-2025 3/3 to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Triveniganj P.S. Case No. 210 of 2025.
