Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)a, 26/35 of the Arms Act.
As per the allegation in the FIR, two persons, namely, Chiku Kumar and Sahil Kumar were arrested by the police with illegal arms and ammunitions. It is further stated that as per the statement of the above two accused persons, it transpired that three accused persons including this petitioner had managed to escape.
It is submitted by learned counsel for the petitioner that from the FIR, it would be evident that name of the petitioner has transpired on the confession of the co-accused
Patna High Court CR. MISC. No.70531 of 2019(3) dt.20-11-2019 2/2 Chiku Kumar, who has already been enlarged on bail vide order dated 10.05.2019 passed in Cr. Misc. No. 26201 of 2019 (Annexure-2). It is further stated that neither the petitioner has been arrested at the spot nor any incriminating article has been recovered from his possession.
Having heard learned counsel for the parties and taking into consideration the facts of this case including grant of bail to the co-accused, Court is inclined to grant bail. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Danapur, Patna in connection with Bihta Police Station Case No. 52 of 2019.
