JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-12-2018 Heard learned counsel for the petitioners and State. The petitioners apprehend their arrest in connection with Complaint Case No. 611 of 2017 for the offence under Sections 323 and 498A of the Indian Penal Code. Petitioners are the father-in-law and the mother-in-law of opposite party no. 2.
Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent. He further submits that the allegation of demand of dowry is false. He submits that the difference in between the husband and wife led to the filing of the present case. He submits that the petitioners would take endeavour to settle the controversy between the husband and
Patna High Court Cr.Misc. No.76971 of 2018(2) dt.21-12-2018 2/2 wife. He also submits that the husband has also filed anticipatory bail application before the court below where he has made statement that he is ready to keep his wife with full honour and dignity.
Considering the aforesaid, the petitioners named above, in the event of arrest or surrender before the court below within one month from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, West, Muzaffarpur in connection with Complaint Case No. 611 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
