2. Let the Defect No. 6(1) as pointed out by the office be ignored in course of the day.

3. The petitioner has preferred this application for grant of regular bail in connection with Sonepur P.S. Case No. 512 of 2022 dated 17.07.2022 registered for the offences punishable u/s 30(a) of the Bihar Prohibition and Excise Act.

4. As per the prosecution case, total 84.96 litres of illicit foreign liquor was recovered from the Chaharam Baba Ghat.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged recovery. The petitioner has eight criminal antecedents as stated in para-3 of the bail petition. The petitioner is in custody since 19.08.2025. The co-accused person has already been granted regular bail by this Court vide order dated 09.07.2025 passed in Cr. Misc. No. 43204 of 2025.

6. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

7. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Saran in connection with Sonepur P.S. Case No. 512 of 2022, with following conditions:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled. (ii) The Court below shall verify the criminal

No.70634 of 2025(2) dt.09-10-2025 3/3 antecedent of the petitioner and at any stage, if it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bonds of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the same of verification.
