This is a petition for grant of anticipatory bail for offence under Sections 341, 325, 307, 302, 506, 301 and 34 of the Indian Penal Code.
Co-accused, Sangeeta Devi, who allegedly started assault against the deceased, has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No. 35148 of 2017 for the reason that the post mortem report did not disclose any external injury on the person of the deceased. There is allegation of assault against the petitioners also.
Considering the fact that the allegation against the petitioners stands to similar footing to that of Sangeeta Devi, let the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each in connection with Town P.S. Case No. 345 of 2017 to the satisfaction of the Chief Judicial Magistrate, East
Patna High Court Cr.Misc. No.34023 of 2017 (3) dt.22-08-2017 2/2 Champaran at Motihari, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
